DJP Update 8-27-2011 Hurricane advice!  #IRENE (posted 1:04 p.m. Central on 8-27-2001)

Below are some of my recent tweets about Hurricane Irene and suggestions for safety.  My experience comes from living in New Orleans all of my life except for my tour of duty with United States Air Force.

Key pointers:

1- follow advice of authorities to evacuate when told to do so.  Possessions can be replaced; not so with life.

2- realize that unless you have been in a major hurricane, it is difficult to imagine all of the unexpected bad things that can happen in addition to flooding of home, loss of electrical power, intense heat in newer construction because of sealed nature and reliance on air conditioning that no longer works, flying debris, tornados spawned by hurricane, and of course, marauders!  People living in New Orleans in Lakeview area survived Hurricane Katrina passage BUT then defective 17th Canal levee gave way and death and destruction ensued.

3- we keep life jackets and inflatable raft in our home in event evacuation routes blocked.

4- fill up gas tank in car prior to evacuation time.  You don’t want to run out of gas in slow stop and go traffic exiting the danger zone.

5- take bottled water and some food that can be stored.  take your portable computer and a backup hard drive.  Keep the back up hard drive in water proof container, even if you have to double bag it in plastic containers.

6- let family members and friends know where you are headed in event they lose contact with you.

7- HAVE A PORTABLE RADIO, AND A PDA PHONE AND LEARN TO TEXT! Have a backup power supply for phone including car charger and portable batteries.  Texting frequently works when voice does not.  GET a WALKIE-TALKIE.  Works well for short distances in event you and family members have to be separated for a short time and distance.

8- HAVE A WATERPROOF ID ON YOUR BODY in event you drown. It took months to identify some of bodies and some never identified after Katrina.  Sad but true.  Difficult to tell identify after long period of time in water.  I visited morgue after Katrina and saw experts taking DNA from tibia marrow to try and match up with relatives searching for lost family.  I wear a dog tag with ID and allergies and meds.  Also, I have waterproof ID in wallet but one never knows if wallet will still be on you in the aftermath of chaos.

9- take some family pictures with you in event your possessions disappear in hurricane or flooding or tornados.  This may be most important possession for you and loved ones.

The 2-1 ruling marks the first time a judge appointed by a Democrat has voted to strike down the mandate. Judge Frank Hull, who was nominated by former President Bill Clinton, joined Chief Judge Joel Dubina, who was appointed by George H.W. Bush, to strike down the mandate.

Judge Stanley Marcus, in a dissenting opinion, said the mandate is constitutional. He was also appointed by Clinton.

The panel partially upheld a ruling issued in January by Judge Roger Vinson, who struck down the entire health reform law. However, the 11th Circuit said that the rest of the legislation can stand even if the mandate is unconstitutional.

IPAB is the “Independent Payment Advisory Board” detailed in sections 3403 & 10320 of PPACA (Public Law 111-148 & amended by P.L. 111-152).

As I have said many times in past, WORDS mean something.  And words should be used correctly.  Not Humpty Dumpty fashion (This means the meaning changes depending on speaker’s circumstances or desires) or in Orwell’s 1984 style.

Cutting funds, just like SGR price-fixing, leads to loss of access to care as balance-billing is not allowed.  Australia allows balance-billing by allowing negotiation between patient and physician of any amount (the “gap” is what they call it) beyond what the government pays.  America does not in Medicare and Medicaid.  In America, the doctor cannot even forgive the co-pay.

But, ACTION is what gets a person or an organization’s policy to the destination.

Over 270 organizations, including AMA, have officially stated their opposition to IPAB.  AMA now has policy to repeal IPAB with the vote taken at the Annual Meeting of the AMA June 2011.  There are members of Congress, both Democrats and Republicans, who oppose IPAB.  ( See http://www.politico.com/news/stories/0711/58655.html for some of them)

But action by all is needed.

Here is one action taken to alert the public about the need to get rid of IPAB:  a press release AND a video ad for national TV.  Let’s all take some action on IPAB and the other important issues such as the restoration of balance-billing without penalty.

CPPR Releases National Ad Outlining Dangers of IPAB

WASHINGTON, DC – The Coalition to Protect Patients Rights (CPPR) is up today with a $1.4 million television ad buy that will be featured on national cable and targeted local broadcast stations discussing the dangers of the Affordable Care Act’s Independent Payment Advisory Board (IPAB).  You can see the ad here.

“I believe it is vital that Americans become educated on the harmful effect the Independent Payment Advisory Board is expected to have on medical care available to seniors throughout the United States,” former president of the American Medical Association and current spokesman of CPPR, Dr. Palmisano said.

Dr. Palmisano continued, “In addition to cutting over $500 billion from Medicare to pay for their new law, the Affordable Care Act’s authors added insult to injury by creating this unaccountable cost-cutting board that will have almost no oversight and the power to cut billions from the Medicare program every year. I want to encourage patients and doctors to contact their elected representatives and demand that IPAB be repealed before the quality of seniors’ medical care is further diminished.”

Starting in 2015, the Independent Payment Advisory Board (IPAB) – a 15-member panel of unelected bureaucrats – will be empowered to make cuts to the Medicare program every year in which spending exceeds targeted growth rates. IPAB’s recommended cuts will become law unless a supermajority inCongress vetoes the board’s proposal and creates its own cost-cutting plan of equal size.  There is no administrative or legal appeal available to citizens.

Support for the repeal of IPAB is broad and bipartisan.  More than 72 House Democrats joined on a letter to then-Speaker Pelosi asking her to remove IPAB from the original health care legislation and in June a letter signed by 270 health care groups was sent to the Hill urging Members to repeal IPAB.  Even the American Medical Association, a vocal proponent of the Patient Protection and Affordable Care Act before its passage, recently announced its opposition to IPAB.

The Coalition to Protect Patients Rights supports a full repeal of IPAB to ensure American patients have continued access to quality health care.

Here is an excerpt from the overview:

The outlook on the long-term rating is negative. We could lower the long-term rating to ‘AA’ within the next two years if we see that less reduction in spending than agreed to, higher interest rates, or new fiscal pressures during the period result in a higher general government debt trajectory than we currently assume in our base case.

Lots of finger-pointing going on.  Stock market dropped 500 points by end of President’s speech today.  Gold is at all time high of $1700.00 per ounce.  Gold price always has been a good indicator of fear in the financial markets.

But you can read about that in other places.  What is obvious to me is one cannot stay fiscally sound if you spend more than you make (or take in taxes if government).  Getting more credit cards does not solve the problem.

And that brings me to a favorite topic of mine:  PPACA

The new healthcare as you well know is, in my opinion, a disaster.  It will not lower the cost of medical care and evidence is emerging on that point.

But enough from me.

Need to get powerful message about the risk to medical care if continued price-fixing and decreased payment to physicians.  More bureaucracy, more regulations, & continued price-fixing will only decrease access to care.  Some in recent debate understand this concept; most don’t pay attention to it.  Medical organizations need to be bold and get message out! If current situation continues and burdens increase, there will be more physicians getting out of patient treatment or becoming employees or leaving medicine for business world, or retiring.  You can count on it.  There is nothing wrong with being an employee IF that is what you want to do.  But it shouldn’t be because solo practice or small group are no longer options.  In the end, greatest harm will be to patients if current trends are not reversed.

Had an interesting speech tour to Washington, DC last week where I had the opportunity to give remarks to staffers of folks in Congress followed by a breakfast speech and Q & A to Representatives regarding IPAB and PPACA.  Heritage Foundation made the arrangements.  I also did a video at Heritage on PPACA and IPAB.

Then flew home from DC and drove from New Orleans to give a speech at The Cloister in Sea Island, Georgia using the opportunity to break-in the “Coyote” 5.0 liter (302 cubic inch) engine in the 2012 Mustang GT.  Outstanding handling and overall performance.   At the beautiful resort, The Cloister, I spoke to the Georgia Medical Eye PAC on leadership and health system reform.  Nice people!  Also got to see 2 of our grandsons as Donald Jr, EVP of MAG, was giving a speech to the group on Accountable Care Organizations and Diego and Pablo accompanied him.  Much fun.

En route back to New Orleans, Robin and I stopped for a few days  at a beautiful beach home loaned to us by a dear doctor friend.  It is right on the beach and is a great place for tranquillity, reflection, and writing.

Meanwhile, the battles continue in Washington, DC on the budget and aspects of PPACA.  IPAB is now being recognized by over 270 organizations, including AMA, as a board that must be repealed.  Meanwhile, PCORI had a hearing in Washington, DC and offered the opportunity for the public to give comments but the time available was a total of 30 minutes on Monday and 30 minutes on Tuesday.  That time is a true total, not per person.  Dr. Peter Lavine of Washington, DC attended and gave excellent comments.  Thanks, Peter!

By the way, PCORI is the PATIENT-CENTERED OUTCOMES RESEARCH INSTITUTE

We have to be careful that PCORI  does not become the partner with IPAB and then become  the equivalent of NICE in Great Britain.  NICE is the National Institute for Health and Clinical Excellence that uses a formula of cost and  “quality-adjusted life-year” to determine if a procedure or treatment is covered.  Their method of rationing.

DJP Update 7-11-2011 IPAB alert in Washington, DC – Lots happening; stop by or tune in

Much activity this week in Washington, DC in Congress and elsewhere regarding the Independent Payment Advisory Board (IPAB) of the Patient Protection and Accountable Care Act of 2010.  At 30,000 feet in commercial jet as I write this update.  House committees take place on Tuesday & Wednesday plus other meetings.  Momentum is moving against IPAB.  Over 270 organizations oppose it as does AMA policy.  AMA policy is to oppose it and work to repeal it.

Those are the facts without opinion.

Now a tad of opinion. Both of these items are misnomers.  The IPAB should be called the unaccountable price-fixing scheme guaranteed to decrease access to medical care (UDAC or Unaccountable Decrease Access to Care).  The PPACA gives America a nationwide experiment of central control,  enhanced bureaucracy, and price-fixing that without a doubt will not decrease spending in the healthcare system nor will it improve quality or access.  How any scientist could support this recreation of schemes that are a failure in Great Britain, Canada, and Sweden remain a mystery to me.  Will not go into the violation of liberty with the individual mandate.  Various names come to mind for this law.

If you thought the SGR price-fixing was a disaster, wait until you see (experience) IPAB.  It consists of fifteen individuals appointed by the president and they will reduce money for Medicare if projections of per capita spending are exceeded.  Congress only can give an alternative that decreases the same amount of money or in a short period of time, or try to override with a 2/3 vote.  Otherwise the cuts go into effect.  The duration of IPAB appears to be eternal.  AND there is no judicial or administrative appeal!  In America?  Wow!  One more thing:  The vote in IPAB can take place with a quorum and only a majority is needed.  Thus it is possible that 5 people will be making these decisions if the quorum or 8 occurs.  Now IPAB is not allowed to ration care by the wording in PPACA.  But keep in mind if the funding is gone, the care is unlikely to occur.  More Humpty Dumpty legislative wording.  And do not forget, PPACA does not allow balance-billing or contract with the patient just as Medicare does not.  Remember Section 1801 of Medicare:  No Federal interference with practice of medicine.  NOT TRUE.

But I repeat what I have said in other DJP Updates and some will instruct me to remove them from these mailings because they strongly disagree with my opinion of PPACA.  I understand most of the time why they depart.  Why two people wanted to be removed when I reported immediately that President Obama informed us that dramatic Sunday night that Osama Bin Laden was killed by the heroic Seal Team 6 will remain a mystery.  I thought that was good news that would be welcomed by all Americans.

The joy of being in America and having the U.S. Constitution.  The joy of being able to voice opinion and marshall the facts.  Those without the facts sometimes attack and do demagoguery.  That is sad.  In time the facts will demonstrate the failure of PPACA unless the U.S. Supreme Court rules it unconstitutional first as I believe it will.

Elections count at all levels.  The plaintiff trial attorneys know this fact.  They really have two issues:  stop cap on damages and preserve contingency fees.

NC governor vetoes medical malpractice limits

RALEIGH, N.C. — Democratic Gov. Beverly Perdue vetoed another bill Friday pushed by the Republican majority at the legislature, this time changes to rules governing medical malpractice cases that would have capped certain monetary awards for negligence victims.

Perdue blocked a bill from taking effect that would have limited awards for malpractice victims to $500,000 for non-economic damages. Those damages cover pain, suffering and emotional distress, but they also cover catastrophic injuries like death or brain damage in patients who can’t seek compensation for lost earnings, like children and the elderly.

Perdue suggested in her veto message that she would sign into law an amended package if lawmakers developed one when they convene next month.

Perdue spokesman Mark Johnson said separately the governor had problems with the cap in the current bill.

“I commend the legislature for addressing this important issue but, in its current form, the bill is unbalanced,” Perdue said in a statement. “I urge legislators to modify the bill when the General Assembly returns in July to protect those who are catastrophically injured.”

The veto is a victory for the state’s trial lawyers and patients who opposed vigorously any cap on what’s called “non-economic” damages – those unrelated to medical bills and compensation for lost wages or income – and a setback for the state’s business community and doctors. For years, they have been seeking limits they say would curtail out-of-control malpractice insurance premiums.

Such a cap had been avoided by Democrats when they were in control of the General Assembly in part because the state trial lawyers’ association opposed the idea. Leaders of the North Carolina Advocates for Justice have been historically aligned with Democratic interests.

“We applaud the governor for vetoing this bill,” said Dick Taylor, the chief executive officer for N.C. Advocates for Justice.

The climate changed when the GOP took charge of both legislative chambers for the first time in 140 years last November. Republican leaders also saw the measure as an economic development tool by attracting doctors to set up shop in North Carolina because of favorable liability laws.

The future of an override vote on this bill is unclear when the legislature begins work again July 13.

“In countless frivolous lawsuits, trial lawyers win big and drive up health care costs for everyone. Yet Gov. Perdue chose to cater to special interests instead of reducing medical costs and improving access to care for all North Carolinians,” Senate President Pro Tem Phil Berger said in a statement. “No matter how she spins it, a veto is a veto, and this one deals a severe blow to the state’s medical community and every citizen struggling to cope with the skyrocketing cost of health care.”

The Senate passed the bill by a wide margin, but the House passed the measure by a vote of 62-44, short of the majority that would signal the chamber’s ability to cancel Perdue’s veto. The House vote wasn’t exclusively partisan – 11 Democrats and 11 Republicans voted contrary to the majority in their respective parties on the final compromise.

The North Carolina Medical Society and North Carolina Hospital Association said in a joint statement they want lawmakers to override Perdue’s veto, saying the bill already was a careful compromise.

“The governor does not get the last word on medical liability reform,” N.C. Medical Society chief executive Bob Seligson said, adding the “General Assembly developed a strong bipartisan bill that will reduce health care costs, protect patients and encourage job growth.”

Perdue signs other bills

The governor signed 24 other bills on Friday, including changes to the state’s workers compensation program and tort reform. She called both measures “good, balanced laws.”

The tort reform bill would “protect those injured and also prevent undue or disproportionate penalties from being imposed upon our companies,” she said. Meanwhile, the workers compensation changes “extend protections to injured people and also provide guidelines and protections for employers.”

The Obama administration has decided to pull the plug on the so-called mystery shoppers who were going to covertly phone doctors across the country in an effort to gauge shortages in primary care physicians that critics say are linked to the president’s health care law.

The proposed study was still in the planning stages, but was intended to address what the administration called a “critical public policy problem.” First revealed to the public Monday by the New York Times, the mystery shoppers were to call medical practices posing as a patient, then ask about accepted insurance providers and wait times to see a doctor.

As the news came out, the White House was attacked by doctors and critics as being “creepy” and imploring Big Brother tactics.

“After reviewing feedback received during the public comment period,” a Health and Human Services official told Fox News, “we have determined that now is not the time to move forward with this research project. Instead, we will pursue other initiatives that build on our efforts to increase access to health care providers nationwide.”

An ObamaCare Legal Precedent? Justice Kennedy gives a boost to the doctrine of enumerated powers.

The Supreme Court’s most important ruling this year may have been its unanimous decision in Bond v. United States, which held that individual citizens can challenge federal statutes when they encroach on authority the Constitution reserves to the states. The decision, authored by Justice Anthony Kennedy, has far-reaching implications—especially for the government’s efforts to defend ObamaCare.

The Supreme Court disagreed. With an unusual unanimity, the court held squarely that individual citizens have every right to challenge federal laws on the ground that they exceed the limited and enumerated powers vested in Congress by the Constitution. The court stated without equivocation that “[b]y denying any one government complete jurisdiction over all the concerns of public life, federalism protects the liberty of the individual from arbitrary power. When the government acts in excess of its lawful powers, that liberty is at stake.”

AND NOTE THIS EXCERPT:

As I said previously, I believe the U.S. Supreme Court will rule PPACA unconstitutional and that Justice Kennedy will be the swing vote against the individual mandate.  This case of Bond v. United States reinforces my view.

Regardless of whether I am right or wrong in my view, prudent individuals and organizations would utilize my “Big A” in my Big A and 25 C’s risk management lecture on the Intrepid Website.

In effect, it says, the Big A says: “ANTICIPATE what could go wrong and be prepared.”

Thus, what advice do the medical organizations have for all of those doctors who are rearranging their practices, closing private practices, and joining hospitals, etc. IF the law is declared unconstitutional.  Best to be prepared for Hurricanes and other major events AND dramatic court decisions that reverse the rush to join an unproven experiment.
