DJP Update 1-17-2012 A short update & serendipity that President Obama glancing through my book ON LEADERSHIP

A few folks have inquired as to why I have not sent out a recent DJP Update.  All is well here.  I have been active sending out tweets at www.twitter.com/DJPNEWS

I placed 4 examples of my tweets below in this update.  So far I have done 4,160 tweets.  Tweets are a great way to get breaking news quickly as well as links to court documents regarding PPACA etc.  Read more of the tweets at the link above.

Here is an exciting development that happened today. I received calls from Washington, DC regarding some photos that were taken of President Obama yesterday.  The photos show him with my book ON LEADERSHIP. The caption on one of the photos states:

Thanks to Dr. Stormy Johnson, former AMA president, for bringing this wonderful story below to my attention.

This man, Van T. Barfoot, born in 1919, was told by his neighborhood association in December of 2009 he couldn’t fly the American Flag on a flagpole in front of his home.

His response at age 90,

“In the time I have left I plan to continue to fly the American flag without
interference”.

Oh, by the way, he won the Medal of Honor in WWII.  An American Hero!  Yes, he continued to fly the flag.

Citation:
For conspicuous gallantry and intrepidity at the risk of life above and beyond the call of duty on 23 May 1944, near Carano, Italy. With his platoon heavily engaged during an assault against forces well entrenched on commanding ground, 2d Lt. Barfoot (then Tech. Sgt.) moved off alone upon the enemy left flank. He crawled to the proximity of 1 machinegun nest and made a direct hit on it with a hand grenade, killing 2 and wounding 3 Germans. He continued along the German defense line to another machinegun emplacement, and with his tommygun killed 2 and captured 3 soldiers. Members of another enemy machinegun crew then abandoned their position and gave themselves up to Sgt. Barfoot. Leaving the prisoners for his support squad to pick up, he proceeded to mop up positions in the immediate area, capturing more prisoners and bringing his total count to 17. Later that day, after he had reorganized his men and consolidated the newly captured ground, the enemy launched a fierce armored counterattack directly at his platoon positions. Securing a bazooka, Sgt. Barfoot took up an exposed position directly in front of 3 advancing Mark VI tanks. From a distance of 75 yards his first shot destroyed the track of the leading tank, effectively disabling it, while the other 2 changed direction toward the flank. As the crew of the disabled tank dismounted, Sgt. Barfoot killed 3 of them with his tommygun. He continued onward into enemy terrain and destroyed a recently abandoned German fieldpiece with a demolition charge placed in the breech. While returning to his platoon position, Sgt. Barfoot, though greatly fatigued by his Herculean efforts, assisted 2 of his seriously wounded men 1,700 yards to a position of safety. Sgt. Barfoot’s extraordinary heroism, demonstration of magnificent valor, and aggressive determination in the face of pointblank fire are a perpetual inspiration to his fellow soldiers.

DJP Comment: Too bad Liberty will not be restored by passing H.R. 1700 or an equivalent that would allow balance-billing.  Let government pay what it an afford and let patients and physicians negotiate the rest.  Instead, more SGR nonsence; the chains remain on doctors.  Until Congress gets courage and restores liberty, Medicare patient access to care will suffer.  Everyone in Congress should be given Medicaid, which price-fixes below Medicare, as the Congressional health plan.  Then the the system would get fixed quickly.  Imagine a patient with internal bleeding and the doctors keep holding conferences as to what to do rather than operating and ligating the bleeder.  Failure to act timely causes patient to die.  That is what Congress is doing to the honorable profession of Medicine.  Yet in all of the presidential debates, not one word is mentioned about this disaster of price-fixing.

WORD FROM SENATE SOURCE (Excerpt from the message)
Sens. Reid and McConnell have introduced a substitute amendment for H.R. 3630, the House passed payroll tax bill.  Among other things, the substitute includes a two-month extension of Medicare payment provisions, which would prevent a 27 percent reduction in physician payments scheduled to take effect on January 1.  Per the unanimous consent request entered into yesterday evening, the vote on this payroll tax agreement will take place at 9 AM TODAY, subject to a 60-vote affirmative threshold.

The legislation provides a zero percent update in physician reimbursement levels for January and February 2012, and stipulates that the payment increase shall be disregarded for purposes of calculating SGR rates for future periods.  The bill also includes several two month extensions of expiring Medicare provisions (which are usually extended with the SGR).  The entire bill is paid for through non-health savings, namely an increase in guarantee fees for Fannie Mae and Freddie Mac mortgages.  CBO scores are not yet available.

Medicare Physician Payment:  Provides for a 0 percent update in reimbursement levels for January and February 2012.  Provides that the payment update shall not be considered when calculating the Sustainable Growth Rate (SGR) reimbursement levels in future periods.

Medicare “Extenders:”  Extends for two months a series of Medicare and health-related provisions, all of which would expire at the end of the calendar year unless otherwise noted:
·         Section 508 hospital reclassifications;
·         Geographic floor for work;
·         Therapy caps exception process;
·         Technical component of certain physician pathology services;
·         Reimbursement raises for ambulance services;
·         Mental health reimbursements (5% increase);
·         Outpatient hold harmless provision;
·         Minimum payment for bone mass measurement;
·         Qualifying Individual (QI) program, assistance to low-income seniors in paying Medicare premiums; and
·         Transitional Medical Assistance, which provides Medicaid benefits for low-income families transitioning from welfare to work.

LAGNIAPPE: I have been doing radio shows in the mornings across the USA and I continue to mention the price-fixing system in government programs as well as the broken medical liability system.  Let’s all try to spread the work via radio shows, Op-Eds, and letters to the editor.  It is up to us to get the message to the American people.  Time to try something different.  Relying on others is not working very well.

DJP Update 12-3-2011 A few words about Twitter & some tweets

Lots going on and my communication of late has been with interviews and speeches PLUS tweets.  I did a media tour in Ohio following the AMA Interim Meeting in New Orleans.  That is reason for lack of recent DJP Updates.

As in in the past, I encourage you to get on Twitter.  You don’t have to send tweets.  One option is just to follow people and news organizations.  The short messages they sent are limited to 140 characters, including spaces.

These tweets come to your smart phone or to your computer or both.  You merely have to select a free or minimal cost software program that receives the tweets.  I keep two such programs on my iPhone 4S: Twitter & Echofon and one on my MacAir 11″.  Echofon has a few extra features either one or some other competitor will suffice for just viewing tweets.  The tweets go to that software and not to your email so don’t worry about the tweets filling up your email.
If you have an iPhone, just go to iTunes and “Apps” and put in twitter in the search engine.  Also, if you don’t see Echofon show up, put Echofon in search engine and it will show up.  When given the choice of free version or PRO version for a few bucks, get the pro version.  But if you just want to follow tweets, the free Twitter app works fine.

If you see an interesting tweet, you can “retweet” it.  That shows up as RT followed by the name of the person who did the original tweet.  I posted a few examples below with the other tweets.

The advantage of Twitter is to get immediate information about news items or items you are interested in, such as #photography or #PPACA or any hobby etc.  You thus will learn the same news that shows up on the evening news and frequently you will learn it hours in advance.  To get “Followers” you have to tweet something of interest to the people or companies who elect to follow you.

Here are some selected tweets recently that I posted.  As you will see below, my tweets usually are about #PPACA, #hcr, #photography, #gadgets,  #leadership, #MedicalLiabilityReform and #quotes PLUS the New Orleans #Saints. To see them all, go to www.twitter.com/DJPNEWS

Inside most tweets, you will see a link that takes you to an article.  Also, a neat search mechanism is to click on a hashmark item, such as #PPACA and the twitter search engine will take you to hundreds or thousands of tweets with that same # hashmark included in the tweet.  Very easy way to find other sources of information on a topic.  INFORMATION is power! Add wisdom to the learned information and you are on the road to leadership.

Great work by Coalition of State Medical and National Specialty Societies with a lot of help from friends, including large medical societies, Take Back the Profession group, etc.!  Keep up the momentum.

Many outstanding speakers went to microphone to advocate for this success at AMA.  But now we need ACTION!

Here is some great news.  AMA Interim meeting just ended and the tweets below tell of important action items concerning private contracting.

1- Dr. Robert Wah, Chair of Board of Trustees, went to microphone today and stated private contracting revision for Medicare will be placed in AMA 2012 Strategic Plan.
2- Substitute resolution 203 passed overwhelming by voice vote; only one negative view at microphone during debate.  The substitute resolution states:

Resolved, That our AMA now initiate and sustain our well-funded grassroots campaign to secure the support of the American People for passage of the Medicare Patient Empowerment Act in Congress as directed by the I-2010 meeting through policy D-390.960.

Note that the Medicare Patient Empowerment Act is H.R. 1700 by Congressman Tom Price, MD, of Georgia. See the link above in second sentence for more info about Act.

Get this passed in Congress and AMA membership will soar.  AMA is a membership organization with all states, specialties, etc. represented in House of Delegates.
Time to take control of our profession again.  As Dr. Bill Plested said when he was president of AMA, “Take back the Profession!”

The petition for a writ of certiorari is granted. In addition to Question 1 presented by the petition, the parties are directed to brief and argue the following question:

“Whether the suit brought by respondents to challenge the minimum coverage provision of the Patient Protection and Affordable Care Act is barred by the Anti-Injunction Act, 26 U.S.C. §7421(a).”

A total of two hours is allotted for oral argument on Question 1. One hour is allotted for oral argument on the additional question.

Supreme Court to Review PPACA

WASHINGTON—The Supreme Court today agreed to decide whether requiring Americans to buy health insurance is constitutional.

Oral arguments will be held in March, and a decision is expected by June, just as the critical electioneering for the next President, the entire House and one-third of the Senate begins.

However, in a sweeping decision, the court also agreed to decide a procedural question that could allow it to postpone dealing with the core issue for several years.

It did so by agreeing to review whether the insurance-mandate penalties included in the Patient Protection and Affordable Care Act are a type of tax that can only be challenged after it is collected, rather than before.

If the court determines that it is premature to deal with the core issue, the court would not have the legal power to consider such a challenge until people are required to pay that tax starting in January 2014, legal scholars say.

Lower courts ruled for the Obama administration on this issue, especially the Fourth U.S. Circuit Court of Appeals, which ruled 2-1 that it did not have jurisdiction to decide the constitutionality of the law because the Anti-Injunction Act requires the person to pay the tax first, seek a refund, and in later proceedings raise the constitutional issue. This court sidestepped dealing with the mandate issue, saying it was premature.

Opponents of the legislation and who believe the mandate to buy insurance is unconstitutional have voiced concern that the High Court could sidestep the critical mandate this year by supporting the 4th Circuit on the procedural issue.

Challengers, including 26 states and most conservatives, view the insurance requirement as an unprecedented intrusion on individual liberty. They contend that Congress cannot use its interstate commerce powers to regulate citizens who choose not to participate in the health insurance market.

The core constitutional issue revolves around the Commerce Clause of the constitution.

The court also agreed to hear the challenge of 26 states of the health law’s expansion of Medicaid, the combined federal/state program that subsidizes health care for low-income Americans.

George T. Patton, Jr. a partner at Bose McKinney & Evans LLP in Indianapolis and Washington and an expert in appellate law said, “In my view, it is no surprise that the U.S. Supreme Court granted review given that a federal appellate court (the Eleventh Circuit) struck down an act of Congress as unconstitutional, other federal appellate courts (the D.C. Circuit and Sixth Circuit) upheld the law as constitutional, and yet another federal appellate court (the Fourth Circuit) found that there were jurisdictional problems with deciding the constitutionality now.”
He said the five and half hours of oral argument granted by the U.S. Supreme Court will allow for a full airing of the legal issues. “This amount of oral argument is much more than the regular hour per case usually set,” Patton said.

Then again, Patton noted, the Court granted three petitions. “It will be interesting to see what order the Court sets the cases for oral argument,” he said.

He cited comments by Lyle Denniston, a reporter and non-lawyer who has been covering the Supreme Court for 52 years, that, “The allotment of five-and-a-half hours for oral argument appeared to be a modern record; the most recent lengthy hearing came in a major constitutional dispute over campaign finance law in 2003, but that was only for four hours.”

Patton cited the amount of time the Court has allotted to the various issues, perhaps implying the order and logic tree of the oral arguments:

Two hours of argument on the constitutionality of the individual mandate;
One and half hours on severability of the individual mandate from the rest of the law;
One hour on jurisdiction given the Anti-Injunction Act; and
One hour on constitutionality of the expansion of Medicaid for the poor and disabled.
In another note of caution, Beth Mantz Steindecker of Washington Analysis, who advises institutional investors and hedge funds, said last week in an investment note dealing with the Decision of the Court of Appeals for D.C. Circuit upholding the mandate that the Supreme Court is likely to uphold the constitutionality of the individual mandate by the end of June 2012 .

However, she said, “Irrespective of what the Supreme Court ultimately does, we believe that the bigger game-changer for this law is the outcome of next November’s elections.

Specifically, she said, a GOP-controlled Congress may work with President Obama on deficit-reducing modifications and design changes, such as an alternative to the individual mandate.

“If there is a Republican sweep, however, they are expected to pursue a ‘repeal and replace’ strategy while keeping some of the more “popular” provisions, Mantz-Steindecker said.

“No matter what, it seems that the health reform law is likely to look different than originally designed by the potential date of implementation,” she concluded.

WASHINGTON—The long-awaited Supreme Court showdown over the Obama administration’s health-care overhaul formally began Monday as the justices agreed to consider a high-profile challenge to the law.

The court, in a short written order, agreed to hear a challenge brought by a group of Republican governors and attorneys general from 26 states, the National Federation of Independent Business and two individual plaintiffs.

The case raises several issues, but chief among them is this: Did Congress exceed its constitutional powers when it required most individuals to carry health insurance or pay a penalty?
The court is expected to hear oral arguments in March, with a decision expected by the end of June. That timeline means the court will rule on President Barack Obama’s signature legislative achievement during the thick of the 2012 presidential campaign.

Guidelines for Public Comments

The Patient-Centered Outcomes Research Institute (PCORI) values and encourages public input. At all public meetings of the PCORI Board of Governors, a public comment period shall be included on the agenda. To ensure that public comment periods are efficient and productive, PCORI will adhere to the following guidelines:

Any member of the public wishing to provide public comment must sign up:

via email to info@pcori.org at least one day prior to the start of the meeting, or
on site at the meeting registration desk at least 30 minutes prior to the start of the public comment portion of the agenda, if remaining time is available.
Individuals offering public comment must limit remarks to not more than three minutes. The Board Chair reserves the right to cut off individuals who exceed three minutes.

If the number of individuals who sign up to provide public comment exceeds the allotted time for comments, the Board Chair may limit individual remarks to a shorter time period.

Written testimony should be submitted to PCORI via email to info@pcori.org.

Individuals are not permitted to hand out materials to Board of Governors members during the Board meeting. Any materials individuals wish to submit to PCORI may be provided to PCORI at the meeting registration desk, submitted via email to info@pcori.org, or mailed to PCORI at 1701 Pennsylvania Ave., NW, Suite 300, Washington, DC 20006.

All testimony and additional materials submitted to PCORI will be provided to appropriate Board members, Methodology Committee members, and staff for review and consideration in PCORI’s work.

Thanks to Dr. Art Fougner for alerting me to these two articles about Governor Jindal.

In addition to Louisiana Governor Jindal’s intelligence, he can make a decision in a crisis.  That is a critical element of leadership.  His leadership during Hurricane Gustav was in sharp contrast to the former Louisiana Governor and New Orleans Mayor during Hurricane Katrina.  Watch him on news talk shows and you see and hear how smart he is.  He doesn’t need a teleprompter or notes with talking points. He excels at speaking extemporaneously.   Of course, the ultimate test of leadership is to see performance in a crisis. I give additional examples of that in ON LEADERSHIP, the expanded 2nd edition.  Yes, he wrote the Foreword to my book (for full disclosure) but I have been a fan of Bobby Jindal for many years.
